What Does a Bankruptcy Paralegal Need to Know?

If you are thinking of becoming a bankruptcy paralegal you may be attracted by the relatively normal office hours and the salary that this qualification attracts. Perhaps you were also good at math at school and love the idea of helping people get out of debt while keeping their homes.

So what do you need to know to become a bankruptcy paralegal?

Most legal assistants who specialize in this field will learn on the job. Prior to the 2005 Bankruptcy Abuse act, filing for bankruptcy was relatively straight forward. In fact a lot of people didn't use an attorney and got on fine.

But the situation has changed. Although the Act has been around for over five years, there is still a considerable amount of confusion over how certain sections should be interpreted. There have been Judges who denied a claim for bankruptcy because the person filing was a teacher who refused to take a second job while on holidays from school. The judge appeared to think that this meant this debtor was not doing his best to repay his debts. Another judge may not have reached the same conclusion.

So a bankruptcy paralegal will need to get to know the local judges and how they are likely to interpret the Act in certain circumstances. The legal assistant will also need to know the differences between a Chapter 7 filing and a Chapter 13 filing if they specialize in personal cases or a chapter 11 and other sections of the bankruptcy code if they deal with companies.

They will also need to hold the skills all good paralegals will have i.e. an ability to work under pressure, to meet tight deadlines, to carry out diligent research, an eye for details as errors on court documents can lead to the case being lost.

This is a rewarding career particularly for those who have worked in finance or have a real wish to make an impact on people's lives. You will be dealing with people who are under severe financial pressure which may be impacting their personal relationships and their health. Your knowledge can help these people to improve their situation. It can also help them not to make their situation worse by filing for bankruptcy when it is the wrong advice for them.
